Terms of Service for FameScale

These Terms of Service ("Terms") govern your access to and use of the FameScale websites, web application, APIs, and related services (collectively, the "Service"). FameScale is operated by Mint Studios Agency SRL, Romania ("FameScale", "we", "us"). By creating an account, purchasing a subscription, or using the Service, you agree to these Terms. If you use the Service for a business or another person, you confirm that you are authorized to bind them to these Terms.

1. The Service

FameScale helps creators, teams, and agencies upload and organize short-form videos, connect supported social media accounts, configure publishing choices, schedule or initiate posts, and review operational posting information. Features may vary by plan, platform approval, account type, location, and connected platform.

Some features may be marked beta, staging, preview, or otherwise limited. We may change, suspend, or discontinue features where reasonably necessary, including when a social platform changes its APIs, permissions, rules, quotas, or review status.

2. Eligibility and accounts

You must be at least 18 years old and legally capable of entering into these Terms.
You must provide accurate account and billing information and keep it current.
You are responsible for safeguarding your credentials and for activity performed through your FameScale account.
You must notify us promptly at akos@famescale.co if you believe your account or a connected social account has been compromised.

You may use Google to sign up or sign in. If your email already has a FameScale account, you must confirm its existing password before linking Google. This links a sign-in method to your existing workspace and does not create a new subscription. Keep access to your Google account and account email secure. Google-only users can set a FameScale password through the email setup option in Settings.

3. Connected social media accounts

You may connect only social media accounts and business assets that you own or are authorized to manage. Connecting an account authorizes FameScale to use the permissions you approve to perform the actions you request, such as retrieving account information, validating publishing capabilities, uploading media, publishing content, checking post status, and retrieving analytics where supported.

FameScale is an independent service. It is not endorsed by, sponsored by, or affiliated with Meta, Instagram, TikTok, or any other connected platform. Your use of a connected platform remains subject to that platform's own terms, policies, permissions, limits, and enforcement decisions.

4. TikTok posting

When you connect TikTok or use a TikTok posting feature, you authorize FameScale to process the video and settings you select and send them to TikTok only after your explicit posting instruction. You remain responsible for reviewing the target creator account, caption, privacy level, interaction settings, commercial-content selections, AI-generated-content selection, and all other post settings before confirming the post.

You agree that:

You will post only original content or content for which you have all required rights, permissions, licences, and releases.
You have the necessary rights to all audio and music in the content and will complete TikTok's required music-usage confirmation truthfully.
You will accurately identify content that promotes your own business or a third-party brand and make all legally and contractually required commercial disclosures.
You will accurately identify AI-generated content where disclosure is required.
You will not use FameScale to copy or redistribute arbitrary third-party content, spam users, evade platform restrictions, manipulate engagement, impersonate others, or publish unlawful, deceptive, infringing, or harmful content.
You will comply with TikTok's applicable Terms of Service, Community Guidelines, intellectual-property rules, branded-content rules, and other applicable platform policies.

TikTok determines whether a post is accepted, processed, moderated, restricted, or published. FameScale cannot guarantee publication, reach, visibility, moderation outcome, or continued availability of any TikTok feature.

YouTube posting (where enabled)

FameScale uses YouTube API Services for the channel and posting operations you explicitly authorize. By using these features, you agree to be bound by the YouTube Terms of Service and applicable Community Guidelines. FameScale is independent of Google and YouTube and is not endorsed by them.

Before upload, review the exact source video, destination channel, title, description, privacy, publication time/timezone, Made for Kids selection and applicable altered/synthetic-content disclosure. You must approve the exact version of any AI-generated title or description. You certify that you have the necessary copyright, privacy and other permissions and that your upload complies with YouTube's terms. FameScale presents the required YouTube certification at the final upload action.

Square or vertical videos up to three minutes are eligible for FameScale's Shorts flow; YouTube determines final classification and processing. A successful upload is distinct from completed processing or public publication. Scheduled publication is applied only after explicit approval and where enabled. A missed schedule is not converted automatically to immediate public publication. Platform processing delays, quota, moderation, authorization changes and edits in YouTube Studio can affect the result.

Cancellation attempts to stop pending work or withdraw a future remote schedule and retain the uploaded video privately. If the platform has already published it or access was revoked, cancellation may require action in YouTube Studio. FameScale does not delete remote YouTube videos by default. Disconnecting or deleting FameScale data does not remove content already stored by YouTube.

5. Your content

You retain ownership of the videos, captions, account information, and other material you submit to the Service ("Your Content"). You grant FameScale a limited, non-exclusive, worldwide licence to host, copy, format, transmit, and otherwise process Your Content only as needed to provide, secure, support, and improve the Service and to carry out the publishing instructions you give us. This licence ends when Your Content is deleted, except for limited retention required by law, security, backup, fraud prevention, or dispute resolution.

You represent that Your Content and our permitted processing of it do not violate law, contract, privacy, publicity, intellectual-property, or other third-party rights. You are responsible for maintaining source copies of Your Content; the Service is not an archival or backup service.

6. Acceptable use

You must not:

Use the Service for unlawful, fraudulent, abusive, harassing, or deceptive activity.
Upload malware or attempt to disrupt, probe, reverse engineer, bypass, or gain unauthorized access to the Service or another user's data.
Sell, sublicense, or provide unauthorized access to the Service, or use it to build a competing service through automated extraction.
Evade plan limits, rate limits, platform quotas, account restrictions, content review, or technical safeguards.
Use the Service in a way that could cause FameScale or a connected platform to violate law or platform policy.

7. Subscriptions, trials, and billing

Paid plans, billing intervals, included limits, trial terms, currency, and applicable taxes are shown before checkout. Unless the checkout page states otherwise, subscriptions renew automatically for the selected billing interval until cancelled. Stripe processes payments and may retain payment and transaction information under its own terms and privacy policy; FameScale does not store complete card details.

You can manage or cancel a self-serve subscription through the Stripe customer portal available in FameScale. Cancellation normally takes effect at the end of the current paid or trial period shown in your billing settings, unless applicable law or the checkout terms require otherwise. Fees already charged are non-refundable except where required by law or expressly agreed by us. Removing a connected social account does not cancel your FameScale subscription.

We may change prices or plan limits prospectively. We will give reasonable notice of a material change where required, and the change will apply no earlier than your next renewal unless you agree otherwise.

8. Platform limits and service availability

Connected platforms impose their own technical limits, posting caps, account eligibility rules, media specifications, and review requirements. Scheduled times are targets rather than guarantees. Posts may be delayed or fail because of moderation, account restrictions, expired authorization, media validation, provider outages, rate limits, or other circumstances outside FameScale's control.

We aim to operate the Service reliably, but the Service is provided on an "as available" basis. We may perform maintenance or take urgent action to protect users, data, the Service, or a connected platform.

9. Intellectual property

FameScale, including its software, interface, brand, documentation, and original content, is owned by us or our licensors and is protected by applicable intellectual-property laws. These Terms give you a limited, revocable, non-transferable right to use the Service for your internal personal or business purposes during your account's active period. They do not transfer ownership of FameScale or permit use of our names, logos, or marks without written permission.

10. Suspension and termination

You may stop using the Service at any time. You can disconnect social accounts or permanently delete your FameScale account using the controls described in our data-deletion instructions.

We may restrict or suspend access where reasonably necessary to address non-payment, a security risk, unlawful use, material breach of these Terms, harm to another user, or a connected-platform requirement. Where practical, we will give notice and an opportunity to remedy the issue. We may terminate an account for a serious or repeated breach.

11. Privacy

Our Privacy Policy explains how FameScale collects, uses, shares, protects, and deletes personal data, including data processed through Meta/Instagram and TikTok integrations.

12. Disclaimers

To the maximum extent permitted by law, the Service is provided without warranties of uninterrupted operation, error-free posting, fitness for a particular purpose, non-infringement, or specific commercial results. Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

13. Limitation of liability

To the maximum extent permitted by law, FameScale will not be liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost revenue, lost opportunities, loss of goodwill, or loss of data arising from use of the Service or a connected platform. FameScale's aggregate liability arising from the Service will not exceed the amount you paid to FameScale for the Service during the twelve months before the event giving rise to the claim.

These limitations do not apply to liability that cannot be limited or excluded under applicable law, including liability for fraud, wilful misconduct, death or personal injury caused by negligence, or mandatory consumer protections.

14. Governing law and disputes

These Terms are governed by Romanian law, without regard to conflict-of-law rules. Courts in Romania will have jurisdiction, except where mandatory law gives a consumer the right to bring a claim in another court or under another governing law. Before starting formal proceedings, please contact us so we can try to resolve the issue directly.

15. Changes to these Terms

We may update these Terms to reflect changes in the Service, connected-platform requirements, law, security, or business operations. We will update the date above and provide additional notice for material changes where appropriate. If you do not agree to revised Terms, you must stop using the Service and cancel your subscription before the revisions take effect.

16. General

If any provision of these Terms is unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our written consent; we may transfer them as part of a merger, reorganization, financing, sale of assets, or transfer of the Service, subject to applicable law. These Terms, together with policies expressly incorporated by reference and any checkout terms, are the agreement between you and FameScale regarding the Service.
